These general terms and conditions governs your use of, and purchases from, the domains www.3SMask.com and their subdomains (henceforth: the site) and will be valid for all your future transactions with 3sMask Ltd (henceforth: 3SMask ; may also be refered to as ‘ca’) and visits to the site. By making a purchase from, or using, the site you have agreed to these Terms and Conditions, and entered into a binding agreement with 3SMask . Please make sure that you have read and understood these Terms and Conditions when using our site. 3SMask reserves the right to revise these Terms and Conditions and users are responsible for keeping themselves updated with such changes.

ORDERING

Orders submitted by you are subject to acceptance by us. We may choose not to accept your order and reserve the right not to deliver for any reason without any liability to you. Examples of when we may not accept your order include, but are not limited to, production problems or if we are unable to authorize your payment. When we have received your order you will receive an automatic e-mail confirming your order. Note that the confirmation e-mail is only an acknowledgement that we have received your order and not an acceptance of your order. Once the order has been processed you will receive a shipping confirmation e-mail. If we are out of stock, and would sell pre-orders, we will clearly display this at the check-out station. In these cases, 3SMask can not guarantee that ordered items will be delivered in near time, but 3SMask will give the best estimation possible. Neither can 3SMask guarantee that the content on the page is free of inaccuracies or typographical errors at all times, nor can 3SMask guarantee that all information is up-to-date and 3SMask may at any time amend the content of the site. 3SMask holds the right to change prices, correct incorrect prices on all orders as well as final sales and will give you the option of placing a new order with the correct price or cancelling your order. We reserve the right to limit the quantities of 3SMask products that we supply, and/or to refuse any order that is unusual or placed in bad faith. In addition, we reserve the right to refuse any order from a client with whom there is a dispute concerning the payment of a previous order. All attempts at fraud will be reported to the police and 3SMask reserves the right to cancel the purchase if any suspicion is raised.

RESALE POLICY

You may purchase products on the site for personal use only and not for resale. By placing an order on the site you certify that you are purchasing the product for your own personal use and not for resale and that you accept our Terms and Conditions. We reserve the right to refuse orders for any reason without explanation.

PRODUCT

3SMask has the right to adjust prices, involve additional cost and change product information such as product pictures and offers without notice. The product images and information texts available reflect the product as much as possible but we reserve the right for any errors that may appear on the page and cannot guarantee that all pictures accurately reflect the true appearance of the products. We cannot guarantee that colors on the website will be true to life. This depends partly on color settings of your computer and monitor. Furthermore, the technical specifications provided on the product is estimated to our best knowledge, based on input from suppliers and independent test institutes. The products are made to improve health, but we cannot guarantee health improvements. Furthermore, we reserve the right from any errors on the product, and emphasize the importance for each user to check each individual product for each credible functionality. 3SMask will provide guides for how to check this under our ‘Get Help’ section. What is more, if the product is used under the wrong condition, not recommended by 3SMask e.g. chemical labs, industrial use, medical use and any other usage rather than civil use, 3SMask reserves the right of inadequate performance. In fact, if used incorrectly, 3SMask acknowledges the risk of leaving a bad impact on the wearer's health, both on skin and respiratory areas, and recommend any wearer to seek consultation with 3SMask if unsure of the masks usage and function. Thus, 3SMask reserves the right to any harmful impact of the mask if used incorrectly. Moreover, mask usage by children should be done under supervision of adults. The mask contains spare parts than should not be eaten or inhaled. Finally, the mask is not to be used for hiding the identity linked to terrorism, robbery, hulligan-attacks or any other illegal events. The intent of the 3SMask mask is to help people in need to breathe cleaner air to stay healthier.

PRICES

Prices on the global site are in CAD(Canadian) Dollars. For customers visiting the site from countries with other local currencies than CAD(Canadian) Dollars, an estimated conversion to the local currency based on the current exchange rate may be displayed. All customers are billed in CAD Dollars and the final price charged to your account or credit card will be calculated in accordance with the applicable exchange rate on the day your bank or credit card company processes the transaction (according to their rates). 3SMask has no control over these rates and do not take responsibility for any potential exchange rate differences or exchange fees levied by your bank. Prices do not include delivery charges such as custom, tax or VAT. You will be responsible for payment of any such import duties and taxes. 3SMask has no control over these charges and cannot predict their amount. For further information we suggest you contact your local customs office and other relevant parties before placing your order. 3SMask may vary the prices of Products listed on the site at any time and without any notice but such changes will not apply to Products in respect of which you have been sent a Dispatch Confirmation. If you have been charged the wrong amount in the web shop 3SMask will give you the option to place a new order with the correct price or cancelling your order. 3SMask however reserves the right to cancel your order prior to dispatch should we find that the price is incorrect. In such case we will notify you by e-mail. We are under no obligation to provide goods to you at an incorrect lower price, even once we have sent a Dispatch Confirmation to you, if the pricing error is obvious and unmistakeable and could have been recognised by you as an error.

PROMOTIONS

Promotion codes are limited to one time per customer and cannot be combined with other offers, if not otherwise explicitly stated. Promotion codes and offers are only valid within the explicitly set time or as far as we have stock and not applicable to previously placed orders.

PAYMENT

We offer safe payment by credit and debit card which supported by PayPal. All payments are processed using Stripe, a PCI certified payment system. We accept payments with Visa, MasterCard and American Express. Payments are debited when the order has been made. When paying by card you will be asked for the card number, the name of the cardholder, its period of validity and the CVC code. We do not store any credit card information and all information is encrypted using SSL encryption, which prevents unauthorized access to card details. There is no extra charge for card payments. In the event no payment has been received after submitting your order 3SMask may automatically cancel your order. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it.

DELIVERY

3SMask ships worldwide. Further information will come regarding delivery by email when time is ready for orders to be shipped. Again, prices on the website do not include delivery charges such as custom, tax or VAT (except EU). You will be responsible for payment of any such potential import duties and taxes. 3SMask has no control over these charges and cannot predict their amount. INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights, such as trademarks and copyright, on the site and in the material published on it are owned by or licensed to 3SMask and it’s affiliates. You are authorized to use this material only for personal, non-commercial purposes. Any use of the site or its content, including copying or storing such content in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of 3SMask . What is more, 3SMask is investigating several patents and design rights of their products, in which case product copying or other disputing activities can be considered illegal and may be brought under charges.

USER CONTENT

The 3SMask website may include user generated content, e.g. from social media applications. 3SMask does not claim any ownership in rights in such content (images, photos, videos, etc.) and take no legal responsibility for it. When ordering a product on the site you will be asked to fill in your personal information. Upon purchase you agree to this information being stored in accordance to 3SMask's privacy policy in order to fulfill our agreement to you as a customer. All personal information saved at the site will be handled with the utmost care. 3SMask treats all personal information confidential and it will not be sold or used for any other purposes than to process and fulfill your order and ensure the best service possible. Your personal data may be disclosed to third parties only when it is necessary to fulfill the purposes described above. You have the right to request access to your data and if there is anything wrong you may have it changed or removed. If this is the case, send us an e-mail clearly stating your name, e-mail address and a short description of the matter. When completing an order you have the option not to receive any promotional information or newsletters from 3SMask . If you no longer wish to receive information that is not necessary to fulfil your order, please unsubscribe directly in the e-mails by clicking the “Unsubscribe” button in the footer of the mailing in question or CONTACT US. For security reasons, we do not store any payment information in our database.

3SMask's responsibility for errors in connection to delivery is limited to existing conditions of sale. 3SMask bears no direct or indirect responsibility for example, but not limited to, production problems, incompatibility, delivery delays, downtime, data loss, additional work or other economic harm. Part of the services mediated through the site are maintained by outside organizations. Where 3SMask acts as an agent for such services, we cannot be held responsible for any errors resulting from their activities. 3SMask cannot be held responsible for any damage caused from using, or not being able to use, the site. 3SMask cannot guarantee a problem-free, uninterrupted, and secure access to the site. FORCE MAJEURE

We have the right to assert force majeure in the event of war, warlike events, civil war, revolution, government sanction, strike, lockout, blockade, natural disaster, bankruptcy or the like. This means that the agreement will not need to be fulfilled in part or in full. Should this, contrary to expectation, occur, we would attempt to notify you.
